AIR Wireless Internet Café and AIR Wireless Hotspot is owned and operated by AIR Networks Company Limited (‘AIR Networks’)

Access to and use of AIR Wireless Internet Café and AIR Wireless Hotspot and the services available through it are subject to the following terms and conditions. By using AIR Wireless Internet Café and AIR Wireless Hotspot you declare that you understand, accept and agree to these Terms and Conditions. These Terms and Conditions supersede all earlier versions. Please read them carefully before activating or using the service.

Definitions:

1. “AIR Wireless Hotspot” is a service that enables users of the AIR Networks network to access the Internet and the services offered through it using a wireless connection.
2. “AIR Wireless Internet Café” is a service that enables users of the AIR Networks network to access the Internet and the services offered through a fixed internet connection.
3. “Users” are customers who by purchasing a card, acquire a username and password, register and make use of, AIR Hotspot. By using/activating the service you represent you are of legal age and agree to be bound by these terms and conditions. If you do not agree to the terms of the agreement, do not use the service. Your electronic acceptance on our web site, your activation or use of the Service constitutes your acceptance of these Terms and Conditions.
4. “Service” means the AIR Hotspot and AIR Internet Café service.

AIR Hotspot and AIR Internet Café acts solely as a means of wireless connectivity to the internet and the billing mechanism for its use. AIR Hotspot and AIR Internet Café servers do not cater for Web and Domain Name Hosting, storage and backup facilities, and e-mail account hosting.

Users shall be responsible for using only equipment that is compliant with the regulations, and recommendations of AIR Hotspot or readily provided by AIR Internet Café.

Users agree not to use AIR Hotspot for any illegal purpose, including but not limited to, distribution of computer viruses, hacking into or gaining access to unauthorised sites, and posting or transmitting of any material which is defamatory, offensive, or of an obscene or abusive nature, or for sending unsolicited junk mail (known as "spamming").

Users agree not to use AIR Hotspot and AIR Internet Café in a way that stops, slows down or otherwise damages the service, thereby seriously jeopardising its effectiveness or functionality for other users.

Users agree not to use AIR Hotspot and AIR Internet Café in any manner which constitutes a violation or infringement of copyright or trademark.

Users agree not to use AIR Hotspot and AIR Internet Café to transmit or post any material for the purposes of commercial publicity, commercial promotion or commercial advertising.

AIR Networks shall not be liable and will not guarantee level of service for those services provided by a third party ISP (Internet Service Provider), such as e-mail, storage and backup facilities, secure encryption, electronic commerce transactions, and so on.

AIR Networks shall not be responsible for any service charges necessary to access the services of third party ISPs.

AIR Networks will not be responsible for any loss of information during transit whilst using AIR Hotspot and AIR Internet Café.

AIR Networks will not be responsible for the accuracy of any information and quality of internet content made available and accessed through AIR Hotspot and AIR Internet Café by the Users.

AIR Networks will accept no liability for the consequences of use of information available on the Internet by AIR Hotspots users. Indemnification: you agree to indemnify, defend and hold harmless AIR Networks, its officers, directors, employees, agents, content providers and suppliers from and against all losses, expenses, damages and costs, including reasonable attorney's fees, resulting from any violation of this agreement or any activity related to your accessing and using AIR Hotspot and AIR Internet Café.

The User shall agree that AIR Networks shall not be liable for any loss or damage whatsoever arising from use of AIR Hotspot and AIR Internet Café. Limitation of liability: Under no circumstances, including, but not limited to, negligence, shall AIR Networks be liable for any special or consequential damages that result from the use of, or the inability to use, the content and the service available through AIR Hotspot and AIR Internet Café.

AIR Networks reserves the right and the sole discretion to revise these Terms and Conditions without prior notice.

These Terms and Conditions shall be governed by the Laws of Malta and any disputes shall be exclusively subject to the jurisdiction of the Courts of Malta.

Users will provide the correct accurate and current identification information when registering to AIR Hotspot and AIR Internet Café.

Users shall use their own encryption or other security mechanisms to ensure their own privacy of transmitted material.

When Users stop making use of the Service, they shall still be liable and responsible for the actions and usage carried out whilst they were using the Service.

AIR Hotspot and AIR Internet Café will comply with the relevant local Data Protection Laws, and any personal details provided for registration purposes with not be disclosed to any third parties without the User’s consent.

AIR Hotspot and AIR Internet Café reserves the right to deny access to all or any part of the service to any particular user without prior notice if AIR Networks has due reason to believe that AIR Hotspot and AIR Internet Café are not being used in accordance with these Terms and Conditions.

AIR Networks will endeavour to maintain its systems available at all times, however, AIR Networks cannot guarantee an uninterrupted service. AIR Networks will not accept responsibility for any interruption of service arising from events beyond its control, including lack of service provided by third parties, network difficulties or electronic malfunction.

AIR Networks reserves the right at any time and at its sole discretion to modify, suspend or discontinue, temporarily or permanently, the service (or any part thereof) with or without prior notice.

AIR Networks reserves the right to change and revise AIR Hotspot tariffs at its own discretion. Such changes will be notified in the AIR Networks website at www.air.com.mt.
